Please read these Terms of Use (“Terms”) carefully before using www.smartshare.health (the “Site”), operated by Smart Share (“we,” “us,” or “our”). By accessing or using the Site, including our AI-powered Chat Assistant, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Description of Service

The Site provides educational tools, comparison information, and an AI Chat Assistant to help you explore health share plans (also called health care sharing ministry plans or medical cost-sharing programs). We are not an insurance company, insurance agent, or insurance broker, and health share plans are not insurance. Participation in a health share plan does not guarantee payment of medical expenses and may not satisfy any legal requirement to carry health insurance in your state, if applicable.

Not a guarantee or offer: Nothing generated by the Site or Chat Assistant constitutes a binding offer, quote, or guarantee of coverage or pricing.

Nothing on the Site, and no output from the Chat Assistant, constitutes medical advice, diagnosis, treatment recommendations, or legal or financial advice. The Chat Assistant is a decision-support tool only. Always consult a qualified physician regarding medical questions and a qualified professional (insurance advisor, attorney, or accountant) before making healthcare coverage decisions.

3. Eligibility

You must be at least 18 years old to use the Site. By using the Site, you represent that you meet this requirement and that any information you provide is accurate to the best of your knowledge.

4. The AI Chat Assistant

The Chat Assistant uses artificial intelligence to answer questions and generate plan suggestions based on information you provide during your session.

  • Accuracy: AI-generated responses may be incomplete, outdated, or inaccurate. Plan details (pricing, coverage limitations, eligibility rules, waiting periods) change frequently and should always be independently verified directly with the plan provider before enrolling.
  • Voluntary information: The Chat Assistant does not require you to disclose medical or health information. Any such information you choose to share is used only to inform recommendations during that session, as described in our Privacy Policy.
  • No professional relationship: Use of the Chat Assistant does not create an agent-client, broker-client, doctor-patient, or attorney-client relationship.

5. User Responsibilities

You agree to:

  • Provide accurate, non-misleading information when using our tools
  • Use the Site only for lawful purposes
  • Not attempt to reverse-engineer, scrape, or misuse the Chat Assistant or Site infrastructure
  • Not submit content that is unlawful, abusive, or that infringes on the rights of others

We reserve the right to suspend or terminate access for anyone who violates these Terms.

The Site may link to third-party health share plan providers or partners. We do not control and are not responsible for the content, accuracy, terms, or privacy practices of those third parties. Any decision to enroll in a plan is between you and that provider, governed by that provider’s own terms and plan documents. Read plan guidelines carefully — health share plans often have specific rules about pre-existing conditions, sharing limits, and eligible expenses that differ from insurance.

7. Intellectual Property

All content on the Site — including text, graphics, logos, and software (excluding third-party AI outputs and any content you submit) — is owned by or licensed to Smart Share and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.

8. Disclaimer of Warranties

THE SITE AND CHAT ASSISTANT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PLAN RECOMMENDATION WILL MEET YOUR NEEDS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART SHARE AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR CHAT ASSISTANT, INCLUDING ANY DECISION MADE IN RELIANCE ON PLAN RECOMMENDATIONS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED $100.

10. Indemnification

You agree to indemnify and hold harmless Smart Share from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Site.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

12. Changes to These Terms

We may revise these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We will update the “Last Updated” date accordingly.

13. Termination

We may suspend or terminate your access to the Site at any time, without notice, for conduct that violates these Terms or is otherwise harmful to other users or the Site.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
